TERMS AND CONDITIONS OF THE MandaCustom ONLINE STORE

I. Definitions

The terms used in these Terms and Conditions are defined as follows:

Customer – a natural person, legal person, or organizational unit without legal personality, which is granted legal capacity under specific regulations, placing an Order through the Store;

Seller – refers to the company Mandacustom Mateusz Oleksiuk, based at ul. Augustowska 43, 16-320 Bargłów Kościelny, Poland, NIP: 8461665546, registered in the Central Registration and Information on Business (CEIDG) maintained by the Minister of Economy, and also the owner of the Online Store;

Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

Terms and Conditions – these terms of service for the online store www.mandacustom.com;

Online Store (Store) – the website available at www.mandacustom.com, through which Customers can, among other things, place Orders;

Goods – products presented in the Online Store;

Sales Agreement – a sales contract for Goods as defined by the Civil Code, concluded between Mateusz Oleksiuk and the Customer via the Online Store;

Consumer Rights Act – the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);

Act on Providing Services by Electronic Means – the Act of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended);

Order – a Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.

II. General Provisions

2.1. These Terms and Conditions set out the rules for using the online store available at www.mandacustom.com.

2.2. These Terms constitute the regulations referred to in Article 8 of the Act on Providing Services by Electronic Means.

2.3. The Online Store at www.mandacustom.com is operated by Mateusz Oleksiuk, based at ul. Augustowska 43, 16-320 Bargłów Kościelny.

2.4. These Terms define in particular:

a) rules for registering and using an account within the Store;

b) terms and conditions for electronically reserving products;

c) terms and conditions for placing Orders electronically;

d) rules for concluding Sales Agreements via the Store.

2.5. The Store may be accessed via devices connected to the internet using a web browser.

2.6. To use the Store, the Customer must ensure internet access via a computer or mobile device.

2.7. In accordance with applicable law, the Seller may restrict services via the Store to individuals over 18 years old. In such cases, Customers will be notified.

2.8. Customers may access these Terms at any time via a link on the homepage of www.mandacustom.com.

2.9. Product information (descriptions, technical and usage parameters, and prices) found in the Store constitutes an invitation to enter into a contract, as defined in Article 71 of the Civil Code.

III. Terms of Use of the Online Store

3.1. To begin using the Online Store, registration is required.

3.2. Registration is completed by filling out and accepting a registration form available on the Store's site.

3.3. Registration requires agreeing to the Terms and providing necessary personal information.

3.4. The Seller may revoke a Customer’s access to the Store, either partially or fully, immediately, for violations of the Terms, particularly if the Customer:

a) provided false, outdated, or misleading information during registration;

b) infringed upon the rights of third parties, including other Store customers;

c) engaged in behavior deemed illegal or contrary to the Seller’s reputation.

3.5. A Customer whose access has been revoked may not re-register without the Seller’s consent.

3.6. The Store takes appropriate technical and organizational measures to ensure the secure transmission of data and communication.

3.7. The Customer is obligated to:

a) refrain from sharing unlawful content (e.g., violent, defamatory, or rights-infringing materials);

b) not disrupt the Store’s operation, including via software or hardware manipulation;

c) not send unsolicited commercial information (spam);

d) not inconvenience other customers or the Seller;

e) use Store content only for personal use;

f) comply with Polish law, the Terms, and general internet usage norms.

IV. Conclusion of the Sales Agreement

4.1. To conclude a Sales Agreement via the Store, the Customer must visit www.mandacustom.com and follow on-screen instructions.

4.2. The Customer selects Goods by adding them to the cart.

4.3. Before finalizing the Order, the Customer can modify data and product selection.

4.4. Once all necessary data is provided, the system displays a summary including:

a) items ordered;

b) itemized and total price including delivery and any additional fees;

c) payment method;

d) delivery method;

e) estimated delivery time.

4.5. To place the Order, the Customer must accept the Terms, provide personal data, and click the “Order” button.

4.6. Clicking “Order” constitutes a binding offer to conclude a Sales Agreement.

4.7. The Customer then receives a confirmation email with all Order details.

4.8. The Sales Agreement is considered concluded upon receipt of this confirmation email.

4.9. The Agreement is in Polish and governed by these Terms.

V. Delivery

5.1. Goods are delivered to the address provided in the Order.

5.2. Orders are shipped via courier. Delivery costs: PLN 30 for prepayment, PLN 40 for COD. The cost is displayed during checkout.

5.3. Delivery time is 2–7 business days from the Order date.

5.4. The Terms are always available via a link on the Store's homepage. The Sales Agreement is confirmed via email and with a printed confirmation, Order summary, and VAT invoice included with the package.

VI. Prices and Payment Methods

6.1. Prices are listed in PLN and include VAT, customs duties, and other charges.

6.2. Payment methods:

b) PayU online payment

c) cash on delivery

VII. Right to Withdraw from the Agreement

You have the right to withdraw from this agreement within 14 days without giving any reason.

The withdrawal period expires 14 days from the purchase date.

To exercise this right, you must notify us via a clear statement (e.g., by mail or email).

You may use the withdrawal form template, but it is not mandatory.

To meet the withdrawal deadline, simply send the notice before the 14-day period ends.

Effects of Withdrawal:

Upon withdrawal, we will refund all payments received from you (excluding delivery costs) without undue delay, and in any event, no later than 14 days from the day we are informed of your decision.

Refunds will be made using the same payment method as the original transaction unless you agree otherwise. No fees will be charged for the refund.

VIII. Complaints Regarding Goods

8.1. Mateusz Oleksiuk is liable to Customers (consumers) under the Civil Code (particularly Articles 556–556[3]) for any physical or legal defects.

8.2. Complaints should be sent to: mandacustom.kontakt@gmail.com. All complaints will be reviewed within 14 days.

8.3. Mateusz Oleksiuk, as the manufacturer, is responsible for warranty coverage.

IX. Complaints Regarding Electronic Services

9.1. The Seller makes efforts to ensure smooth Store operation, and will address reported issues promptly.

9.2. Customers must promptly report any technical issues.

9.3. Issues may be reported by email (mandacustom.kontakt@gmail.com) or via the contact form.

9.4. Complaints should include: full name, issue description, and date of occurrence.

9.5. Complaints will be addressed within 14 days. If more time is needed, the Customer will be notified.

X. Final Provisions

10.1. Disputes with consumers will be resolved by courts in accordance with civil procedure regulations.

10.2. Disputes with non-consumers will be handled by the court having jurisdiction over the Seller’s registered office.

10.3. Matters not covered by these Terms are governed by the Civil Code, the Act on Providing Services by Electronic Means, and other applicable Polish laws.
